TERMS OF USE

genus, genusConnect, theWall.AI, Mingle, genusCoach, and CareVoice exist to build Communities of Care around every person in need. We use technology, communication, and AI to foster deeper connections, improve relationships, and bring out the best in all of us.
By accessing or using the genus website, platform, mobile apps, or related services (the "Services"), you agree to these Terms of Use (the "Terms"). If you do not agree, please do not use the Services. For questions, contact support@genusconnect.org.
- These Terms form a binding agreement between you and the genus entity that operates this website and platform.
- We may update these Terms from time to time; material changes will be posted and, where appropriate, communicated. Continued use after changes means you accept the updated Terms.
- We strive to keep the experience accessible, inclusive, and respectful. Please contact us if you encounter barriers.
- "genus", "we", "us": The genus organization that operates the genusConnect website and related Services.
- "User", "you": Any individual or entity that accesses or uses the Services.
- "Platform": The genusConnect website, mobile applications, theWall.AI, Mingle, genusCoach, and related digital tools.
- "Services": Features, content, and programs delivered by or through the Platform.
- "User Content": Any text, media, or other content you submit or upload.
- "Communities of Care": Secure, invitation-based groups you or your care team create around a Person of Care to coordinate support.
- "Person of Care": The individual at the center of a Community of Care (often a patient, family member, or person receiving support).
- "Care Codes" (including 211-411 codes): SMS keywords (such as "DISCHARGE") that, when texted to a designated short code, link you to specific genusConnect programs or Communities of Care.
- You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Provide accurate, current, and complete information and update it when it changes.
- You agree not to: (a) harass, threaten, or harm others; (b) post unlawful, defamatory, or discriminatory content; (c) infringe or misuse intellectual property; (d) attempt to access accounts, data, or systems without authorization; (e) use bots, scrapers, or automated tools except as expressly permitted; (f) interfere with or disrupt the security or performance of the Services.
- We may suspend or terminate access at our discretion, including for violations of these Terms, suspected fraud, or security risks.
genus and its partners may offer programs that allow you to engage by texting Care Codes (such as "DISCHARGE") to a short code, including 211-411 in the United States. These programs may send you links, reminders, educational resources, onboarding prompts, or other messages related to a specific program or Community of Care.
- Opt-in and consent: By texting a keyword or Care Code (for example, "DISCHARGE") to 211-411 or another genusConnect-designated number, you affirm that you are the subscriber or authorized user of that mobile number and you consent to receive SMS/text messages for the associated program. You may receive a confirmation message when you first enroll.
- Message frequency: Message frequency varies based on the specific program, your interactions, and care plan (for example, additional messages around key milestones such as discharge or appointment follow-ups).
- Message and data rates: Message and data rates may apply according to your mobile carrier plan. You are responsible for any such charges.
- Carrier & delivery: Messages are transmitted via one or more SMS providers and participating wireless carriers. Carriers are not liable for delayed or undelivered messages, and service availability may vary by region and carrier.
- Opt-out: You may opt out of a program at any time by texting "STOP" (or any supported opt-out keyword such as STOP, END, CANCEL, UNSUBSCRIBE, or QUIT) to the same number (for example, 211-411). You will receive a confirmation message and will no longer receive program messages, except where additional notices are required by law.
- Help: To receive assistance regarding an SMS program, text "HELP" to the same number (for example, 211-411) or contact support@genusconnect.org.
- Program-specific terms: Certain programs promoted by health systems, payers, or community organizations may include additional or different SMS terms, which will be presented at enrollment. In case of conflict, those program-specific terms govern your participation in that program.
- Geography: Unless otherwise stated, 211-411 and similar short-code programs are available only to users with mobile numbers issued by participating U.S. carriers.
- genusAI stores cached, human-approved answers and public improvement requests to deliver better responses.
- Identifiers, including names, demographics, and other protected health information, are removed or minimized in prompts sent to language models wherever feasible. Sensitive exchanges run on models we train and host ourselves.
- AI-driven suggestions are informational only and do not replace professional medical, legal, financial, or other professional advice. Always consult qualified professionals for critical decisions.
- Your feedback helps us refine the AI responsibly under appropriate safeguards.
- genus operates as a Business Associate under HIPAA, signs Business Associate Agreements with the covered entities and partners it serves, and safeguards PHI accordingly.
- The Services support care coordination, education, and communication, but are not a substitute for medical diagnosis or treatment.
- The Services are not designed for emergencies. If you believe you or someone else is in immediate danger or experiencing a medical emergency, call 911 (or your local emergency number) and do not rely on genus, genusAI, or SMS programs for emergency response.
- You control who joins your Community of Care; invite only trusted participants and revoke access if concerns arise.
All genus logos, names, designs, and platform content are owned by genus or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal or authorized organizational purposes.
If you believe that content on the Services infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to: DMCA Compliance, genus Inc., 440 Burroughs St, Suite 169, Detroit, MI 48202. Include the work infringed, URL or location of the allegedly infringing material, your contact information, a statement of good-faith belief, and your physical or electronic signature.
- We may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.
- You retain ownership of your User Content but grant genus a worldwide, royalty-free license to host, use, reproduce, adapt, and display it as needed to operate the Services.
- You may not use genus trademarks or branding without our prior written permission.
- Some features may require payment. Fees are typically non-refundable and subscriptions may auto-renew.
- We may suspend or terminate access for unpaid fees, misuse, security risks, legal requirements, or other legitimate reasons.
- You may terminate your account and stop using the Services at any time, but remain responsible for accrued charges.
- The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, and our total aggregate liability arising out of or related to the Services will not exceed the amount you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.
- These Terms are governed by the laws of the State of Michigan (excluding conflicts-of-law rules). Disputes will be handled in accordance with the dispute resolution provisions in these Terms, which may include binding arbitration and a waiver of certain class or representative actions where permitted by law.
- We retain information as described in our Privacy Policy, including to comply with legal obligations (such as HIPAA retention rules), resolve disputes, and maintain security and continuity of the Services.
- The Services are primarily directed to users in the United States; certain features (including SMS/short-code programs) may be limited to U.S. carriers and laws.
- If you access the Services from outside the United States, you are responsible for complying with local laws and understand that your information may be transferred to and processed in countries (including the U.S.) that may have different data-protection laws.
